Enrolment Terms and Conditions

The terms you agree to when you enrol in any MenoBoss certification.

What these terms cover

These terms apply to every MenoBoss certification, guide and programme, whether you pay for it or it is free. By enrolling in, accessing or completing any of them, you agree to them. The version that applies to you is the one current on the day you enrol.

There is one set of terms rather than one per programme. Anything that differs between programmes — the fee, the scope, the pass mark, the access period — is published with that programme rather than written in here, so that these terms cannot quietly disagree with themselves.

Who you are agreeing with

These terms are an agreement between Optimus Woman Limited, a company registered in New Zealand (company number 8618432, NZBN 9429051141721), trading as MenoBoss ("we", "us"), and you.

Where an organisation buys a programme for its people, a separate agreement covers the commercial relationship with that organisation. These terms still govern your own use of the credential.

What a MenoBoss certification is, and what it is not

Every MenoBoss certification is a non-clinical educational credential. It teaches a non-clinician to understand the menopause transition and to act, within a stated boundary, on what she has understood.

It is not a clinical or medical qualification. It does not confer registration as a health practitioner under the Health Practitioners Competence Assurance Act 2003 or any equivalent law anywhere. It carries no registration of any kind, with anybody.

It confers no licence to practise anything. It is not a qualification to treat, to advise on treatment, or to diagnose, and it is not a qualification to set yourself up in business as a menopause professional. Diagnosis, prescribing and treatment always remain with a qualified clinician.

Where MenoBoss holds accreditation from a continuing professional development body, that accreditation is of the training. It is not a licence, it is not a regulatory approval, and it gives no credential holder a clinical scope. Whether a professional body recognises the points is a matter for that body.

Your scope

Every MenoBoss credential carries a scope line, set out word for word on the Scope of Practice page. It is exact. The lines are not all the same length: one credential carries two verbs, another carries four.

Your scope is the line for the programme you enrolled in. You do not add a verb to it, and you do not borrow one from the tier above. Holding one credential does not give you the scope of another, and you must not describe yourself as though it does.

Education only, and no medical advice

All course materials are provided for education and general information. Nothing in any programme is medical, clinical, legal or financial advice, and nothing in it should be relied on in place of advice from a qualified professional.

You must not use the training to diagnose, to treat, or to advise any person on medication or medical treatment. That includes telling any person to start, to change or to stop a medicine or a supplement. Telling somebody to stop something is as far outside every MenoBoss scope as telling her to start it, and being medically right about it does not bring it back inside.

What you must never say about your credential

You may state that you hold the credential, by its full name, once you have completed it, and you may describe what your scope line allows.

You must never state or imply that you are a health practitioner; that the certification is a clinical or professional qualification; or that it licenses, registers, permits or otherwise entitles you to practise, to treat, to advise on treatment or to diagnose. You must not advertise or offer services that hold you out as doing anything beyond what your scope line allows.

You are responsible for making sure the way you describe and use the credential complies with the law of the country you are in. Health-title restrictions differ across the countries MenoBoss serves and some carry criminal penalties. Our choice of New Zealand law below governs the agreement between us. It does not govern your conduct where you live.

Using the credential and the MenoBoss name

The MenoBoss name, marks and brand assets are ours. You may use them only as we permit in writing and only in the form we supply.

You may not resell, sub-licence, franchise, or hold out authority to certify, train or accredit anybody else under the MenoBoss name unless you hold the separate MenoBoss Trainer licence. That licence is permission to teach and assess MenoBoss certifications and nothing else. It is not a clinical licence either.

Course materials and copyright

All course content — handbooks, modules, assessments, frameworks, diagrams and the programme architecture — is owned by MenoBoss or licensed to us, and is protected by copyright.

We grant you a personal, non-transferable licence to access and use the materials for your own learning. You may not copy, distribute, publish, resell or create derivative training from them, or use them to build a competing programme. That licence is a copyright licence over the materials. It is not a licence to practise, and nothing in these terms grants you one.

Fees and access

The fee for the programme you are enrolling in, and whether it includes GST, is stated on the enrolment page at the moment you enrol. Some programmes are free of charge, and where a programme is free there is no fee, no administration charge and nothing to refund.

Where a fee applies it is payable in full on enrolment and access opens as soon as payment clears. We may change a price. The price that applies to you is the one current when you enrol, and a change never affects access you already hold.

Where a programme has an access period, an extension is available on request, for any reason, at no cost.

Cancellation and refunds

If within 14 days of enrolling in a paid programme you decide it is not for you, and you have completed no more than the first module, you may cancel and we will refund your fee in full. No reason is required and none will be asked for.

After 14 days, or once you have gone beyond the first module, the fee is not refundable for a change of mind. The programme is delivered digitally and all of it is available to you from the moment you enrol.

None of that touches your statutory rights. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, and nothing in them attempts to. Where you are buying as a consumer, those rights cannot be contracted out of. If a programme is not supplied with reasonable care and skill, is not fit for a purpose you told us about before you enrolled, or is not what we described, you are entitled to a remedy. Where a failure can be put right we will put it right at no cost to you. Where the failure is substantial you may cancel and obtain a refund. If you enrol from Australia the same position applies under the Australian Consumer Law, whose guarantees also cannot be excluded.

If we withdraw a programme, or cannot give you the access you paid for, we refund the part you have not been able to use, whether or not you ask.

We may choose to offer a refund, transfer or credit where we are not obliged to. Doing that once does not oblige us to do it again, and it is not an admission that a refund was owed.

Privacy and your data

We collect and handle personal information, and any health information you give us, in accordance with the Privacy Act 2020 and the Health Information Privacy Code 2020, and our Privacy Policy. By enrolling you consent to us handling your information as that policy sets out.

Certification records are retained so that a credential can be verified years after it was issued.

Assessment, marking and certification

A credential is issued only on completion of the required assessment at the standard we set. The pass mark for a programme is published in advance and does not move for any learner. Re-sits are unlimited, untimed and free. No fee is charged at any point in the assessment process: not for a re-attempt, not for a reassessment, not for an appeal.

Some MenoBoss assessments are marked by an AI model. Where that applies to your programme it is disclosed on the AI Use and Marking page before you begin, and four rules apply to your result. A result within five points either side of the pass mark is reviewed by a person before it stands. A random sample of other results is reviewed as well, without holding up your certificate. Moderation may only move a result in your favour: a pass stays a pass. And if marking is unavailable, your answers are saved, nothing is recorded, and it does not count as an attempt.

You may ask for a human review of any marked result, at any time, at no cost, without giving a reason. Asking is never held against you and it cannot make your result worse. Knowledge checks inside a module are marked by you and are feedback rather than a gate. Reflection writing is never marked and never read for grading.

You may use AI to help you think, plan or check your understanding. You may not submit AI-generated text as your own assessment work, because the assessment exists to evidence what you can do.

Re-attempts, reassessment and appeals

Three different things, and it helps to know which one you want. A re-attempt is sitting an assessment again. A reassessment is asking us to mark work you already submitted a second time, with a different marker. An appeal is challenging the decision itself, or the way it was reached. You do not have to ask for a reassessment before you appeal, though it is usually faster.

For a reassessment, write to info@menobossglobal.com within 20 working days of the day we notify you of the decision. Tell us which assessment it was, when you sat it, and why you think the decision is wrong. There is no form. The work is marked again by a marker who did not mark it the first time, looking at what you actually submitted — you cannot add to it or explain it further, because the second marker has to see the same evidence as the first. We acknowledge within 5 working days and complete it within 20, and you get the outcome in writing with reasons.

A reassessment can produce three outcomes: the decision stands; the decision changes and your result is amended; or a fault in the process is found, in which case you get a fresh attempt at no cost and the earlier one is set aside.

To appeal, write to us within 20 working days of the decision you are appealing. There are four grounds: that the decision was not supported by the evidence you submitted; that the published marking criteria were misapplied; that the published process was not followed; or that something happened during the assessment that affected your performance, which you told us about at the time or as soon as you reasonably could. Disagreeing with the standard itself is not a ground. The pass rules are published in advance and are the same for every learner.

An appeal is heard by a moderator who did not mark the original work, did not reassess it, and had no part in the decision. Where no such person is available, or the appeal concerns the moderator, it goes to an independent reviewer from outside the programme. That separation is the point of the procedure and it is not waived for convenience.

We acknowledge an appeal within 5 working days and decide it within 20 working days of that acknowledgement. If we need longer we will tell you why and give you a date, and beyond 40 working days you get a written explanation whether you ask for one or not. Four outcomes are possible: the decision stands; it is overturned and an amended certificate issues within 10 working days; the work is marked again by a further marker and that mark stands; or a fresh attempt is offered at no cost.

Every request, reason and outcome is recorded. Asking for a reassessment or lodging an appeal is never held against you in any later decision about your enrolment or your credential.

Withdrawal of a credential

We may withdraw or revoke a credential where it was obtained by misrepresentation, or where you breach these terms, in particular the scope and title obligations above.

We notify a revocation in writing with our reasons. You may respond before it takes effect, unless the breach is one that puts a woman at risk, in which case access is suspended first and the conversation happens afterwards. A revocation may be appealed in the same way as an assessment decision.

Your consumer rights, and our liability

If you are a consumer in New Zealand you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that cannot be excluded, and nothing in these terms limits them.

To the extent the law allows, MenoBoss is not liable for loss arising from your use of the training in practice, from any act or omission of a MenoBoss credential holder, or from reliance on the materials as though they were medical advice. The programmes are educational. How you apply them is yours.

Governing law

These terms, and the certifications, are governed by the laws of New Zealand, and you and MenoBoss submit to the exclusive jurisdiction of the New Zealand courts.

That choice governs the agreement between us. It does not change the fact that if you operate in another country, that country's own health-title, advertising and consumer laws may apply to what you do there.

Changes, and how to reach us

We may update these terms. The version that applies to you is the one current when you enrol. Where a change is material we will tell you by email to the address on your enrolment.
